Deep Dive Episode 80 – New Executive Orders Directing Agency Guidance

On October 9, President Trump signed two Executive Orders designed to restrict Executive Agencies’ use of guidance documents. The first prescribes new standards for developing guidance documents and making all guidance accessible online. The second limits the use of guidance in civil enforcement. How significant are these orders? What impact will they have on regulatory policymaking? What has been the initial reaction to these new measures?

Susan Dudley, Director of the George Washington University Regulatory Studies Center, has recently written about the orders in Forbes and Paul Noe, Vice President for Public Policy at the American Forest and Paper Association, has shared his perspective in Law360. Each will join us to offer their insights.
